Congressman Brian Babin has introduced the Birthright Citizenship Act, a legislative proposal aimed at revising the current interpretation of the 14th Amendment. The bill seeks to limit automatic citizenship to children born in the United States only if at least one parent is a U.S. citizen or national, a lawful permanent resident residing in the country, or a lawful immigrant serving actively in the U.S. Armed Forces.

The introduction of this legislation is consistent with former President Donald Trump's efforts to prioritize reforming birthright citizenship laws. According to Babin, granting automatic citizenship to children of illegal immigrants stems from an incorrect interpretation of the 14th Amendment, which was initially intended for ensuring that recently freed slaves received full rights as American citizens.

Babin stated, "America’s citizenship laws should reflect fairness and respect for the rule of law." He emphasized that this legislation aims to correct long-standing misuse and address what he described as a loophole incentivizing illegal immigration and exploiting U.S. citizenship through birth tourism. "Citizenship is one of our nation’s most precious privileges," he added.

Data from the Center for Immigration Studies (CIS) suggests that one out of every ten births in the United States involves an illegal immigrant mother. Furthermore, nearly 400,000 expectant mothers reportedly cross into the U.S. illegally each year with plans to give birth there. Once these children receive automatic citizenship, they can facilitate chain migration by allowing extended family members to obtain legal residency status. This situation has also contributed to a global industry focused on birth tourism.
