A regular meeting of the Houston City Council was held at 2:00 p.m., Tuesday, December 7, 2021, with Mayor Sylvester Turner presiding with Council Members Amy Peck, Tarsha Jackson, Abbie Kamin, Carolyn Evans-Shabazz, Dave Martin, Tiffany Thomas, Greg Travis, Karla Cisneros, Robert Gallegos, Edward Pollard, Martha Castex-Tatum, Mike Knox, David W. At 1:33 p.m., Mayor Turner called the meeting to order and before they get started he wanted to recognize State Representative Joe Deshotel from the Beaumont area. He had the privilege of working with Mr. Deshotel for at least 20 years. He read and heard he is retiring at the end of this session.
Mayor Turner recognized Council Member Peck for a proclamation. Council Member Peck presented a proclamation to Veteran Advocates, Services and Training (VAST) recognizing them for their great dedication in helping reintegrate our nation’s heroes back into the community. Accepting the proclamation were Valerie James, CEO/Founder, and members of the Board.
Council Member Kamin presented a proclamation to the winners of the ADU/HOU Accessory Dwelling Unit Design Contest. Accepting the proclamation were Siobham Finlay and Adam Bermon.
Council Member Gallegos presented a proclamation to Houston Community College System Chancellor, Dr. Cesar Maldonado, recognizing the 50th Anniversary of Houston Community College System. Accepting the proclamation were Trustee, Eva Laredo and Vice Chancellor, Dwight L. Smith, III.
Mayor Turner recognized Council Member Kubosh (on behalf of Council Member Robinson) for the Invocation after which he led the Pledge of Allegiance.

Council Member Castex-Tatum moved to adopt the minutes of October 19-20, 2021, October 26-27, 2021 and November 2-3, 2021 and Seconded by Council Member Robinson, all voting aye, nays none. MOTION ADOPTED
Due to health and safety concerns related to COVID-19, this meeting will offer the options to participate by videoconference or in-person. The meeting will be open to the public but restrictions regarding masks, allowable room capacity, and seating arrangements may be in place.
The public meeting location will be City Hall Council Chamber, 901 Bagby, 2nd Floor, Houston, Texas 77002. The Mayor, as presiding officer of City Council, and some Council Members will be physically present. Other Council Members will be participating by videoconference in accordance with the provisions of Section 551.127 of the Texas Government Code applicable to a governmental body that extends into three or more counties. Mayor Turner stated that he wanted to review some of the procedures for conducting the Virtual Public Session. He is requesting for Council Members to speak slowly and clearly because this will help the City Secretary, the Closed Captioner and the General Public. After roll call, they established there was a quorum. If by chance, for example, they have to leave, just let them know on the chat screen if they are leaving temporarily or if they are leaving for the duration because otherwise, they will assume that Council Members are present. If they are making the motion or seconding a motion, they will need to state their name and their action clearly so they can have it down for the record. The Agenda Director will be monitoring the chat and will provide him their names. Please don’t use the chat room just for chatting. Please mute themselves when they are not speaking and unmute themselves when they are recognized to speak. For the general public, in order to be recognized as a public speaker, they have to sign up for the meeting on Monday by 3:00 p.m. in the Office of the City Secretary and then they will call the speakers name in the order that they have signed up. When their name is called, press *6 to unmute themselves. They may only speak when recognized and to please note that if they speak during the meeting and he hasn’t recognized them, he will have to mute and/or remove them off the call.

Mayor Turner stated that if he can recall, this was the developer seeking the variance and it was going before the Planning Commission in which the Planning Commission put their decision off for 2 weeks.
Council Member Kamin stated to Mayor Turner that the residents have had concerns about the pedestrian realm, traffic, blind spots and things across the street from Sinclair Elementary. The neighborhood has done an incredible job wading into this issue and trying to grapple with it. The parents of the elementary school are involved and she wanted to thank the Planning Department for stepping up when the developer was applying for a variance. They have been working to get certain concessions, like safe sidewalks and things of that nature. They are going to be having a community meeting this Thursday with the Super Neighborhood, where the Planning Department will be presenting some of the concessions. She appreciates the Planning Commission deferring it so that residents actually grapple with it and understand what these concessions are. She thinks what they are hearing and understanding is that some of these shouldn’t have to come through a variance “negotiation”. Had the developer not sought a variance, these things wouldn’t be added in and the burden that’s falling on residents trying to advocate for safety, it’s a lot. Council Member Kamin stated that this is where everything stands and the Planning Department has been great working with the residents and getting that information.

Mayor Turner stated to Ms. German-Wilson that he is aware of some of the problems. It is a new system but in talking with ARA, there are some features of the new system that have not worked the way that they were anticipating it to work. They are kind of gravitating back to some aspects of that old system. The new system is being evaluated and there are some hiccups and they are making the adjustments. The other thing with 311 is that they are short on 311 operators.
Members of Council commented and questioned Ms. German-Wilson’s statement at length.
Mayor Turner stated that he just received a note that they are already moving on 311 Phase II and are bringing back an improved version of the “See Click Fix”. That is being addressed as they speak.

Mayor Turner stated that Mr. Valle is indicating he is having problems with the apartments handling maintenance concerns. Mayor Turner stated that they will forward this to the Department of Neighborhoods or Houston Public Works and he will work with his Council Member to see how they can address this.
Council Member Pollard asked Mr. Valle, what specific complaints does he have about the property? He stated that he has issues with his kitchen. There is something broken and when he submits a request, they come out and they address it but they don’t fix it. Council Member Pollard stated to Mr. Valle that he can log those complaints into 311, so that someone from the City may be able to address that. Then his office can follow up with the property management. He is going to leave his card with his contact information so he can e-mail or call their office with the 311 service request number.

Mayor Turner stated to Mr. Underwood that he thinks he has been talking to Houston Public Works because he has a note about having problems with his water bill. The account in question has not been paid since January 2020. Mayor Turner asked Mr. Underwood if that was true, in which he said yes. Mayor Turner stated that it has a high current balance on it right now and that the property does not qualify for financial assistance. There are some issues that he doesn’t want to read them all out loud but he would like him to speak to Sal Rueda, who is with Houston Public Works and he can assist him.

Council Member Gallegos thanked Ms. Goffney for coming in and sharing what happened to her. She advised him that they claimed the weeds were 48 inches high. Council Member Gallegos stated to Mayor Turner that there is a concern and an issue on this. He had a constituent that called his office and they went out and cut their lot. They only cut half of it because it was so hot. They went back out there on a Monday to finish cutting their lot and the contractor was already out there cutting their lot. The land owner told the contractor that he was there to finish cutting the lot and the contractor ignored them, finished cutting the lot and then sent them an outrageous bill. There is something wrong with contractors going out and cutting people‘s yards when they are bypassing vacant lots that are taller than 48 inches. There was an issue he brought to the attention of the Department of Neighborhoods and he is still waiting for them to call him back. Council Member Gallegos is requesting publicly that the Department of Neighborhoods meet with him and give him the procedures on these contractors.
Mayor Turner stated to Council Member Gallegos the problems that they are having is that there are people who are demanding and insisting that they go and cut the lots and cuts those weeds. There needs to be a balance. Council Member Gallegos stated the amount was $4,000 and Mayor Turner stated to him that he understands and he isn’t defending the amount. Mayor Turner stated to Ms. Goffney that they will look into it.

Council Member Pollard thanked Ms. Colunga for coming forward and that he is her Council Member. He heard her complaints and his office is going to reach out to her directly so that they coordinate ways in which to approach the property management and address the issue that you are telling them about today.
Council Member Plummer gave a number to everyone listening today. Retaliation is obviously illegal, not only from a City perspective but from the State as well. The City of Houston does have an opportunity to express that information or make a report and the phone is (832) 394-6200 ext. #5 or they can e-mail fairhousing@houstontx.gov. This information is for retaliation complaints if anyone has experienced retailation from their landlords for making complaints or otherwise. The City of Houston is here to support them.

Mayor Turner stated to Mr. Rodriguez that he is looking at a memo saying that Wastewater Operations performed a field investigation on November 30, 2021 and located multiple structural issues on the private community sewer before connection to the City’s Wastewater Collection System at Norwood Street. The issue was referred to the Houston Health Department to handle since the issue is located on private property and not within a public utility easement. Wastewater Operations recommends the homeowner to work with a certified plumber to have the private sewer issue resolved.
Council Member Cisneros stated to Mr. Rodriguez that they have been working with him to pass on information and making connections and trying to help. They will continue to do that and she knows he isn’t hearing the answers he wants to hear but they are working hard to make sure they connect him with different departments.

Council Member Evans-Shabazz stated that this has been an issue since she‘s been in office. They have worked very diligently because it does present an unsafe circumstance for the bikers. There is not much room at all for emergency vehicles to go through. She is hoping that they can look at it because like she said, “if they go one way north and then another way south, that really could help.“ Sometimes they have large groups of bikers and they are coming down the one way, which means that the ones that are trying to access going in the other direction are either stopped or they are faced with some unsafe situations or could lead to a confrontation, as well. She really wants them to look at this because if there is a viable solution, she really would like to see it.
Mayor Turner stated that let him deal with one of those issues and it‘s in respect to emergency vehicles and first responders. He hasn’t gotten any criticisms or complaints from Chief Pena or anyone with the Fire Department saying that they can’t access people’s homes in that area. Then David Fields with the Planning Department has reached out to the Fire Department and they have heard no criticisms that they can’t access people’s homes.

Council Member Evans-Shabazz stated that she knows that Mayor Turner indicated that there have been no complaints by Chief Pena but she doesn’t know if the complaint has risen to that level. There is information from the fire station regarding how diffcult it is to service their vehicles and all of that. If it could move to the next street over, she thinks it would facilitate a much safer environment. She has to personally say the width of that lead her to think she can drive down the bike lane. At that time, the signage just had a right turn. Since then, they have changed it, so now people are essentially turning almost from the middle of the street, across the bike lane to make a turn. Again, if there is a viable solution, she really wishes that they would look at that. She does think it presents an unsafe environment. She would like to meet with Houston Pulblic Works to see if there is something they can do. She knows that it’s probably going to cost money, in all likelihood, but sometimes they have to weigh those things out and determine what is most important.
Mayor Turner stated that he just didn’t stop at Chief Pena’s level but he also drilled down to Fire Station 7 when there were criticisms being raised that the bike lanes might affect the safety drills and fire protection out in that area. The e-mail that was sent back to David Fields who is over their transportation sector in Public Works, from the Captain said, “I highly doubt if HFD, a member from Station 7, gave any testimony referring to the safety in that area. It doesn’t make any sense but I will ask the other Captains at Station 7 if they know anything about this. I’m fairly certain they are going to say the same thing I just did.“

Mayor Pro Tem Martin stated to Ms. Hardin that he is reading through some notes and this has been going on since Tropical Storm Nicholas. For liability reasons, the Urban Forestry cannot evaluate the tree’s health or even authorize its removal. The Forestry recommendation was for her to hire a private arborist to evaluate the tree from the backyard. The Municipal Courts Department is now the appropriate contact to address the concerns as the Department of Neighborhoods has attempted to gain owner compliance and they were unable to abate the minimum standards violation. Their recommended course of action is to take it up through the Municipal Courts Department.
Council Member Peck stated to Ms. Hardin that her office will call her today to help navigate through the next steps here. It sounds like they can’t come on private property. It might be more of a civil matter in this case but they will contact her to figure all this out.

MAYOR’S REPORT
Mayor Turner stated for the first time in over 30 years, the World Petroleum Congress, the WPC, is in Houston. It started Sunday at the George R. Brown Convention Center and they have welcomed more than 5,000 attendees, including ministers of energy, CEO’s and others representing 70+ countries. A few weeks ago, they thought the numbers would get up to 3,500 but actually a little bit more than 5,000 have registered for the conference. The focus is the future of energy and of course Houston is home to more than 4,500 energy firms and a hub to so many others. He wanted to give a shout out to Houston First. He, of course, wanted to acknowledge the Chairman, David Mincberg, and Michael Heckman, President and CEO, and their entire team. They have been instrumental on the WPC and it has gone extremely well, he also want to recognize the former CEO of Chevron, Jeff Shellebarger, for spearheading and being the leader of this whole effort to bring them here. He knows that Council Member Knox was at the reception last night. He wanted to encourage all Council Members to attend because the exhibition hall at the George R. Brown Convention Center is spectacular. It’s just been a terrific event and he thinks the closing will be later on this evening. He certainly wanted to give a huge thank you for all of the persons responsible for making that happen and the people have thoroughly enjoyed it.
In respect to the Omicron Variant, on Monday, the Houston Health Department confirmed finding samples of the Omicron Variant in the City’s Wastewater System, although a case has not been confirmed in the City of Houston. COVID-19 vaccinations are still your best shot to reduce these cases, prevent serious illness and death and slow the emergence of new variants. He wanted to encourage people, if it’s been six months since they got the Pfizer or Moderna, get the booster shot. If it’s been 2 months since they got the J&J, get the booster. People with kids 5 years and older, have them get the vaccine.
Mayor Turner stated he got up this morning and checked out the news report, as Santa was making his way around the North Pole, he got stuck with climate change but he kept going. As part of this report, he wanted to make a special presentation and giving recognition to a beloved figure in our community. For 40 years, Richard Reyes has suited up and spread holiday cheer as Poncho Claus. We have seen him on television and parades but most importantly in the neighborhoods. Mayor Turner requested he stand up and come to the podium. For four decades, he has worked tirelessly to ensure kids across underserved and under resourced neighborhoods have something under the Christmas tree come Christmas morning. Much of his work relies on the gifts that come from other Houstonians and without the generosity of the people of this wonderful city, Poncho Claus’ efforts would not be nearly as effective and many kids would fall short in receiving things for the holiday season. The past 2 years have been difficult for so many and certainly difficult for Poncho Claus but he stayed the course. Charitable donations may feel a bit more difficult for some to give when they are facing crisis of their own. Poncho Claus, himself, have seen significant health issues but puts on the that zoot suit to spread the message of the holiday season. When all of them heard about his challenge for this holiday season, they wanted to reach out to some generous people in our community to see how they could help Poncho Claus. Mayor Turner wanted to thank Poncho Claus for being committed, dedicated, even with health challenges, he has stayed the course and he has done his job extremely well. He just view him as an icon in this city. Mayor Turner, Representatives of DRC, Joe Neinman, Vice President, Clif Kenney, Texas Operations Manager and James Donatto, and former director of Solid Waste Management, Harry Hayes, presented a check of $10,000.00 to Poncho Claus.
Members of Council congratulated and thanked Poncho Claus for all that he does for the community.
