City of Houston City Council met Nov. 16-17.

A regular meeting of the Houston City Council was held at 2:00 p.m., Tuesday, November 16, 2021, with Mayor Sylvester Turner presiding with Council Members Amy Peck, Tarsha Jackson, Abbie Kamin, Carolyn Evans-Shabazz, Dave Martin, Tiffany Thomas, Greg Travis, Karla Cisneros, Robert Gallegos, Edward Pollard, Martha Castex-Tatum, Mike Knox, David W. Robinson, Michael Kubosh and Sallie Alcorn, Randy Zamora, Legal Department, and Stella Ortega, Agenda Office, present. Council Member Letitia Plummer absent on personal business.
At 1:40 p.m., Mayor Turner called the meeting to order and recognized Council Member Thomas for a proclamation.
Council Member Thomas presented a proclamation to the Houston Area Coalition of Chapters of Omega Psi Phi Fraternity, Inc. celebrating 110 years of the organization being founded. Accepting the proclamation were Jeffrey Williams, President; Cliff Hodrick, Secretary; Erick Powers, Treasurer; John Barker, Chaplain and Breland Walker, Undergraduate Representative.
Council Member Martin presented a proclamation to BakerRipley celebrating the 2021 BakerRipley Houston Turkey Trot. Accepting the proclamation were Rene Solis, Chief Program Officer, Steve Gomez, Chief of Special Projects and Sassy the Turkey.
At 2:05 p.m., Mayor Turner recognized Council Member Castex-Tatum for the Invocation. Council Member Castex-Tatum invited Sister Mary Margaret Pham, OP, and Sister Catherine Teresa Bui, OP (Dominican Sisters of Mary Immaculate Province) and after which Council Member Castex-Tatum led the Pledge of Allegiance.

Council Member Castex-Tatum moved to adopt the minutes of September 28 & 29, 2021 and October 5- 6, 2021 and Seconded by Council Member Robinson, all voting aye, nays none. MOTION ADOPTED
Due to health and safety concerns related to COVID-19, this meeting will offer the options to participate by videoconference or in-person. The meeting will be open to the public but restrictions regarding masks, allowable room capacity, and seating arrangements may be in place.
The public meeting location will be City Hall Council Chamber, 901 Bagby, 2nd Floor, Houston, Texas 77002. The Mayor, as presiding officer of City Council, and some Council Members will be physically present. Other Council Members will be participating by videoconference in accordance with the provisions of Section 551.127 of the Texas Government Code applicable to a governmental body that extends into three or more counties. The meeting will also be streamed as usual on the City’s website (https://www.houstontx.gov/htv/index.html), Facebook site

Mayor Turner stated that he wanted to review some of the procedures for conducting the Virtual Public Session. He is requesting for Council Members to speak slowly and clearly because this will help the City Secretary, the Closed Captioner and the General Public. After roll call, they established there was a quorum. If by chance, for example, they have to leave, just let them know on the chat screen if they are leaving temporarily or if they are leaving for the duration because otherwise, they will assume that Council Members are present. If they are making the motion or seconding a motion, they will need to state their name and their action clearly so they can have it down for the record. The Agenda Director will be monitoring the chat and will provide him their names. Please don’t use the chat room just for chatting. Please mute themselves when they are not speaking and unmute themselves when they are recognized to speak. For the general public, in order to be recognized as a public speaker, they have to sign up for the meeting on Monday by 3:00 p.m. in the Office of the City Secretary and then they will call the speakers name in the order that they have signed up. When their name is called, press *6 to unmute themselves. They may only speak when recognized and to please note that if they speak during the meeting and he hasn’t recognized them, he will have to mute and/or remove them off the call.
Mayor Turner recognized Council Member Pollard for a procedural motion. Council Member Pollard moved that the rules be suspended for the purpose of adding David Gordon to the end of the 3 minute Agenda List of Speakers and Seconded by Council Member Kubosh, all voting aye, nays none. Mayor Turner recognized Council Member Kamin for a procedural motion. Council Member Kamin moved that the rules be suspended for the purpose of moving Traci Riley, John Zavala, Thomas Rowland, and Alice Newport to the top of the 3 minute Non-Agenda List of Speakers; add Myles Sasser after Alice Newport for 3 minutes and then to be followed by Robert Choate for 1 minute and Seconded by Council Member Castex-Tatum, Council Member Martin voting no, balance voting aye. Council Member Robinson stated that he has spoken, as of late last week, with Director Haddock. She is convinced that there really wasn’t an appropriate vetting within the Public Works Department about the Electrical Code component. This is with all due respect to what was otherwise a relatively fair process. He knows there have been some objectives and they have taken under advisement all of those thoughts and considerations that have been brought to the committee. In particular, the electrical code is such that it is something that the director has recommended they pull from the current proposed agenda so that this would be put forward without that component of what has previously considered. He thinks with every intention that they are going to tag this or refer it back to the administration for further consideration.
Mayor Turner stated that he wanted to be very clear, the low voltage exemption has been put back into the final version.

In regards to Mr. Moreno’s remarks, Mayor Turner asked Mr. Moreno if this is in addition to what exists today? Mr. Moreno answered, yes. Mayor Turner stated that he understands but he wants to make sure when you make something and add changes that’s not currently in existence, you never know if somebody else is going to get upset. But to get us back to the status quo, that would be the low voltage change exemption that they have been talking about. Mr. Moreno stated to Mayor Turner that is correct but making that amendment to No. 8 would allow that to give more definition to exactly what that is.
Council Member Robinson thanked Mr. Moreno for coming here today and he thinks that what council is hearing is that something that needs to be clarified through the Public Works Department. The item will be tagged and brought back so Mr. Moreno‘s concerns and those about the nature of the low voltage exemption will be explained. They are working with the Communications Director for Public Works. They will be putting out the specific language addressing the technical components of what they are concerned with. He wanted to thank everyone for the feedback. This is very helpful and that language will be issued very soon.

Council Member Pollard stated that as he listens to the speakers and he looks at the agenda list and many of them are calling regarding the same item. It causes him to think about the process in which they take to engage those who are within a particular industry space to ensure that they have their voices heard on the front end. It seems that when they were going through the process of amending or implementing policy language that they speak to those who do that job on a day to day. He thinks if those parameters were in place from the beginning, then many of these questions would have been answered and they could find a compromise that works for all parties involved.

Mayor Turner stated to Mr. Gordon that this one is a safety issue. This is coming from strong recommendations from the Houston Fire Department. It’s either go with 5 ft or put a one hour resistant firewall. Again, this is coming with strong support from Chief Pena and the Houston Fire Department. This is a life safety issue.

Council Member Kamin stated that they have a few residents coming to speak, especially their Civic leaders. Her Chief of Staff and representation from Council Member Alcorn‘s office was on-site yesterday with a lot of the residents. She told Mayor Turner that they do have concerns and it appears there is not consideration for the pedestrian realm and pedestrian safety with this variance request. She knows that the Planning Department is taking a hard look at this and she is in contact with them. She isn’t going to chime in on every speaker but she wants each of them to know that they are working with them, she appreciates them and they have raised concerns about public safety and the pedestrian realm.

Mayor Turner stated to Mr. Lucey that he is trying to understand what the request is because he is looking at a note saying,“with the exception of the curb and driveway, the damages that have been raised have been repaired. The driveway and curb can be repaired in the same manner as the sidewalk, which HPW repaired“. Having recommendations of installation of a root barrier as a preventative measure but that‘s the responsibility of the property owner. Having a structural engineer to evaluate the property to determine if the tree was the cause of the property damage, which is the responsiblity of the property owner. He told Mr. Lucey that he was going to take a second look at this.

MAYOR’S REPORT
Mayor Turner stated that the first item of business is something that they look forward to every year. It is the CMC “Hold A Snake” event. Mayor Turner recognized Council Member Alcorn, who chaired the CMC this year.
Council Member Alcorn thanked all of her colleagues who contributed this year. They raised money for the BARC Foundation, which is near and dear to many of them. She wanted to welcome their good friends from the Houston Zoo, who will bring up the snake. Every year they raise money for CMC in which everybody donates a part of their earnings to a specific cause. This year they are on track to raise more than they have in the past. She requested Council Members Robinson and Martin to come down to pet the snake because they raised the least. Council Member Martin wasn’t present in chamber to pet the snake, but Council Member Travis stepped in to pet the snake. The Houston Zoo Keeper brought a Brazilian Rainbow Boa named Iris. Council Member Alcorn thanked everyone.
Mayor Turner stated that he had the privilege of being at the White House on Monday for the Bi-partisan Infrastructure bill signing by President Biden. One thing is clear is that Houston is on people’s minds, which is good. He is glad that the Bi-partisan Infrastructure bill had been signed and he thinks that Texas, along with Houston, will fair well. They are certainly looking for projects that are shovel ready and it is a good step forward. He wanted to thank the Biden Administration, the people in Congress for the passage of the bill. He did want to give a special acknowledgement to our congressional delegation in our region. This coming Saturday, they will be at Henderson Park for the Mayor’s “Love Our Park” event. The Park is at 4250 Elysian and he will be there at 11:00 a.m. He hopes to see the unveiling of the improvements made for the neighborhood to enjoy. The Thanksgiving Parade is back and he wants to encourage everyone to participate in the 72nd Annual HEB Thanksgiving Parade. This will take place on Thursday, November 25th at 9:00 a.m. in downtown. This event is one of the oldest Thanksgiving Day parade in the country. He is inviting everyone to come out and join in this holiday celebration. They have so much to be thankful for after 20 months of COVID. This year’s Grand Marshall is Dr. Peter Hotez, who did an incredible job keeping everyone inform of this pandemic.
Mayor Turner stated that they are in the middle of Climate Week. This week, the Mayor’s Office of Resilience and Sustainability is hosting the Second Annual Virtual Houston Climate Week, in partnership with the University of Houston-Downtown. The weeklong virtual conference will update the public on the implementation of both Resilient Houston and the Houston Climate Action Plan. Today’s focus is on green jobs and community and youth climate action. He wants to thank everyone in the Office of Resilience and Sustainability for their work in this area. Lastly, he received word about the death of Beatrice Green, a Houston Civil Rights Activist who cofounded the first Lutheran Church in Texas for African Americans. She died November 9th at the age of 108. She and her aunt cofounded Holy Cross Lutheran Church, the first black Lutheran church in Texas because she didn’t like that other churches were making black worshipers enter through a back door. She was also involved in the community and fought for voting rights. She and her group of friends would travel by bus to Austin and would sit on the Capitol grounds all night Friday and Saturday protesting for the right to vote. They continued this action until the Voting Rights Act passed in 1965. Beatrice and others worked to open Precinct 247, the first black voting precinct in the Cuney Home of Houston’s Third Ward. Her funeral is Friday and she is a reminder to us all that the fight continues and he doesn’t want anyone to assume that things are behind us. We are still dealing with issues of being treated fairly and equitably. The things that Beatrice Green and Beulah Shepherd would not allow unfortunately we are allowing too much to take place today. When he reads of her story and reflect on her life, it’s a reminder that we still have a lot of work to do. To be treated fairly in every sense of the word.
