MEMBERS OF THE BOARD PRESENT: Rosa Alvarez, Emily Anderson, Susan Baird, Sarah Benavides, Chris Canonico, Pete Côté, Steve Gillett, Don Johnson, Ken Keller, William Latimer, Shannon Lucas, Alan Petrov, Kathy Rogers, Melinda Salazar, Kyle Sears, Shaun Theriot-Smith

MEMBERS OF THE BOARD ABSENT: Augustus Campbell, Katherine Mears, Lindy Murff

PRESIDING: Alan Petrov, Chairman

1. CALL TO ORDER OF THE REGULAR BOARD MEETING. Chairman Petrov called the regular meeting of the Board of Directors to Order at 10:05 a.m. and noted the presence of a quorum.

2. ACCEPT COMMENTS FROM MEMBERS OF THE PUBLIC. Mr. Beau Burns, representing Remy Jade Generating, L.L.C., stated that he is present for the permit review process for their permit. Mr. Burns stated he had no objections to the hearing examiners recommendations for the permit.

3. APPROVAL OF THE MINUTES OF THE REGULAR BOARD MEETING OF SEPTEMBER 8, 2021. Mr. Latimer moved that the minutes of the regular meeting of September 8, 2021, be approved; it was seconded by Ms. Rogers. Chairman Petrov put the question, and after the vote, announced the motion carried. None opposed.

4. HEARING EXAMINERS REPORT. Ms. Helen Stewart Truscott presented the Hearing Examiner's Report for September 2021, including the testimony and findings for Allen Noland & Freddie Tillery, Veronica Paz, and John & Leigh Anne Raymond. Mr. Latimer moved to accept the Hearing Examiner's recommendations, as amended; it was seconded by Ms. Rogers. Ms. Salazar abstained as to Harris Co. M.U.D. 441. No other abstentions. Chairman Petrov put the question, and after the vote, announced the motion carried. None opposed.

5. EMERGENCY PERMITS. The Board considered the General Manager's action in granting emergency permits to Souhail Adam, AMV, Gulf Coast Stabilized, and Trinity Spring Oaks. There were no motions to review the actions of the General Manager.

6. RECEIVE PRESENTATION OF THE 2021 EPA WATERSENSE PARTNER OF THE YEAR AWARD OF EXELLENCE IN EDUCATION AND PROMOTING THE WATERSENSE PROGRAM. Dr. Petersen introduced Veronica Blette, Chief of the Water Sense Program at the Environmental Protection Agency (EPA), who presented (virtually) the award to the District.

7. RECEIVE BRIEFING FROM STAFF ON THE STATUS OF THE JOINT REGULATORY PLAN REVIEW. Dr. Petersen briefed the Board on the status of the Joint Regulatory Plan Review.

8. GENERAL MANAGER'S REPORT. Mr. Turco submitted the General Manager's Report. (The General Manager's Report is in full in the official records of the Harris-Galveston Subsidence District as part of the Board's Agenda Packet for this meeting.)

9. LEGAL MATTERS. Mr. Ellis updated the Board on recent litigation on groundwater issues.

10. EXECUTIVE SESSION. None.
