A regular meeting of the Houston City Council was held at 2:00 p.m., with Mayor Sylvester Turner presiding with Council Members Amy Peck, Tarsha Jackson, Abbie Kamin, Carolyn Evans-Shabazz, Dave Martin, Tiffany Thomas, Greg Travis, Karla Cisneros, Robert Gallegos, Edward Pollard, Martha Castex-Tatum, Mike Knox, David W. Robinson, Michael Kubosh and Sallie Alcorn; Randy Zamora, Legal Department, and Marta Crinejo, Agenda Director, present. Council Member Letitia Plummer absent on personal business.

At 1:37 p.m., Mayor Turner called the meeting to order and recognized Council Member Kamin for a proclamation.

Council Member Kamin presented a proclamation to the Montrose Center in honor of Pride Month highlighting their countless contributions and services to the Houston LGBTQ+ community and beyond. To accept the proclamation was the Executive Director, Ann J. Robinson.

In the interest of public health and safety, members of the public may only participate virtually in accordance with the Governor’s orders. Mayor Turner stated that he wanted to review some of the procedures for conducting the Virtual Public Session. He is requesting for Council Members to speak slowly and clearly because this will help the City Secretary, the Closed Captioner and the General Public. After roll call, they established there was a quorum. If by chance, for example, they have to leave, just let them know on the chat screen if they are leaving temporarily or if they are leaving for the duration because otherwise, they will assume that Council Members are present. If they are making the motion or seconding a motion, they will need to state their name and their action clearly so they can have it down for the record. The Agenda Director will be monitoring the chat and will provide him their names. Please don’t use the chat room just for chatting. Please mute themselves when they are not speaking and unmute themselves when they are recognized to speak. For the general public, in order to be recognized as a public speaker, they have to sign up for the meeting on Monday by 3:00 p.m. in the Office of the City Secretary and then they will call the speakers name in the order that they have signed up. Mayor Turner stated to Mr. Vandusen that with respect to the two decrees, a part of it is to prevent a fine for failing to meet the benchmarks. It’s included in the water and wastewater study. Then there are two other elements, in addition to the consent decree. One deals with making sure we maintain our debt to credit ratio for our Master Bond Convenants. That is a must. Otherwise we can be deemed in default and affect our credit ratings and everyone will pay more. The second is for additional infrastructure projects like major water main leaks that are happening way too many times throughout the City of Houston.

Members of Council commented on Mr. Kepper‘s statement. Council Member Kamin asked Mayor Turner about the initial amount that the federal government was demanding that we, as a city, pay compared to what the negotiating team and the Mayor’s team was able to get it down to.

Mayor Turner stated that this consent decree started in 2010, when the Environmental Protection Agency said to the City of Houston, ”you have too many overcharges, discharges coming from your wastewater treatment facilities into your water stream“. And as we all can recall, many communities throughout the City, when there was a heavy rain, there was a bad odor. When the EPA came to the city and said,” You must address this. Your infrastructure is inadequate“.The City of Houston didn‘t do anything. In 2013, the Department of Justice came in stating that they must do this. What they were proposing, in terms of their consent decree, was going to cost the City as much as $5 to $7 billion above the city’s existing spend over the next 22 years. When he came into office in 2016, the federal government came to him, saying that they had been dealing with the City of Houston since 2010 and time is up. The City will either enter into this consent decree or they will impose penalties on the City of Houston of at least $100,000 per day until they make these corrections. We worked with the Obama Adminstration because they refused to enter into a consent decree that was going to cost that much. Then they worked with the Trump Adminstration and the Trump Administration was saying to the City of Houston that we will enter into a consent decree. What ended up happening was that instead of it being $5 billlion over and above our existing spend, the consent decree came down to $2 billion. That is what the federal judge signed several months ago. We made the public announcement on April 1st, and we had committee meetings with BFA, and two public hearings. We ended up reducing the amount of the consent decree to $2 billion over our existing spend of the next 15 years. Now we have to pay for it.

Mayor Turner stated to Mr. Kruger that in 2014, when he concluded being the Director of Houston Public Works, the Department of Justice stepped in and was getting ready to hit the City of Houston hard for not moving on that consent decree. The City of Houston has been dealing with this since 2010. In 2013, the Department of Justice came in because the city didn’t do anything in addressing these issues. Mr. Kruger stated that was correct and it actually started before 2010. Mayor Turner then stated that it started with the sanitary sewer overflowers before 2010. The problem got so bad that it drew the attention of the EPA in 2010. It got so bad that it reached the federal government‘s attention. That‘s why the EPA stepped in 2010 and 2013 because the city didn‘t address the decree. The Department of Justice stepped in to initiate legal action against the City of Houston. Then you, Mr. Kruger, ended your tenure as the Houston Public Works Director in 2014.

Council Member Travis stated to Ms. Maynard that he agrees with her comments. He does know that things are improving at BARC, which he thinks are in large part to Nikki Cooper, Tina Paez and the Mayor. He also understands that when she saw the clip from Greg Damianoff, she would be mad. With that said, he thinks everybody agrees that Milo was a mistake but the other 2 dogs did exhibit problems and issues. The veterinarians at BARC are very good people and if they made that determination, he will stand by that. He will also say that they put animals down when they show aggressiveness because we don’t take the time to see what that aggressiveness happens to be. It’s also a matter of money. Do we have the time and money to put into the programs to determine that?

Mayor Turner stated there are very dedicated people at BARC. The live release rate at BARC is now at about 95%. Euthanasia is the last resort. He’s looked at the previous cases, including Milo, and they should have waited longer because there was a transport issue. With respect to the other dog with behavioral issues, they tried to sedate the dog and they had someone there that was going to rescue the dog. They also agreed that there were serious behavioral issues and they would not take the dog. With respect to the 3rd case, the dog had a very bad leg injury and the veterinarian said it would be inhumane for the dog by moving him from one place to another. Again, the people at BARC are very dedicated and they are picking up at least 100 animals a day. Even in the month of May, there were 2,200 animals that went through the BARC system. We‘re always trying to do better and we are going to continue to strive to do better.

MAYOR’S REPORT

Mayor Turner stated on the Mayor’s report that we’ll be meeting with representatives of HOPE, Houston Organization of Public Employees. We have been negotiating with them on their contract with the City and he’s pleased that they have reached an agreement. That announcement will be made after City Council today. To the council members, we will lay it all out to them regarding the terms of the agreement. HOPE represents over 11,000 municipal workers that work for the City of Houston.

With respect to Solid Waste, we are needing more drivers. We are looking to hire 100 drivers with commercial driver’s licenses. Based on the budget amendment that passed. There’s a signing bonus of $3,000. He wants to put the word out. We may have the equipment, but if we don’t have the drivers, you’ll still have some issues. The other thing he wants people to be aware of is, as more houses are built in the city, the routes that these drivers are on are servicing more people, which takes longer. He wanted to remind the people in the City of Houston on junk waste month. The amount that you are allowed is the amount that you can put in a pickup truck. If you can’t put it on the back of a pickup truck, it’s not allowed. He has been driving around the City of Houston this month and what was out in front of several people’s houses would have been several pickup truck loads. That takes time and it slows the process down. He just wanted to give people some idea of what’s allowed. He wants to thank the Solid Waste drivers for working everyday, including Saturday’s, and often times they don’t finish their routes until about 8:30 p.m.

Mayor Turner stated that he still wants to encourage people to get the vaccine because the new delta strain is real and it’s more infectious. He also wants to remind people of the crimes that have been taking place. He has asked businesses to increase their reward for Crime Stoppers from $5,000 to up to $15,000 on some of these crimes. And, lastly, for soccer fans, we have a new owner for the Houston Dynamo Club. Yesterday, he was there at the BBVA Stadium to welcome Ted Segal to the City of Houston as the new majority owner of the club which includes James Harden.
